Just back from yekaterinburg and happily married ...just wanted some information about oksana coming to stay for a few weeks before we apply for our spouse visa

oksana currently has a 6 month visitor visa to the uk that runs out in september...she came to the uk on it in april for 2 weeks ,But now our circumstances have changed as she is now my wife.....we dont want to book any flights until we know for sure that She can still travel on the visitors visa without affecting our application when she returns to russia for the spouse visa.....I contacted the uk embassy about 3 weeks ago about this but they never replied

Hi Figgy,
congratulations on your marriage, i hope you'll both be very happy together. I'm afraid i don't know the answer to your problem, common sense would say that of course her visitor visa is still valid, but as you well know, common sense and the U.K.B.A. just don't go together. You best get confirmation from British embassy/U.K.B.A. before you book any flights.

Figgy, your wife visiting on a Visitor visa after you marry is fine, I did this with my wife after we married and she is happily living here.

Thanks for advice guys....The wedding was awesome,Russian hospitality is amazing and it really made our wedding day...Oksana found an email address for the ukba in uk.I forgot to mention that my original query regarding using the visitor visa after the wedding was sent to the uk embassy in moscow i think ,so hopefully the uk address will answer us this time around with a straight yes or no

The correct answer is that if the visa is valid, she can use it for visiting as often and for as long as the validity period...

thanks....i have another problem,didn't get the pay rise i was expecting and now iam 100 pounds a year shy of the 18,600 sponsorship minimum.....can a letter from employer stating regular overtime help

A letter from your employer stating that you will have regular O/T will defiantly not hurt especially considering that you are only £100 a year shy of the minimum.

Hi Figgy,
I'm no expert, but surely if you can show that you earn in excess of £18,600 with your P60 or with the 6 months payslips which you are obliged to provide for spouse/ILR visas, then you should be o.k.? I'm sure someone will correct me if i'm wrong, but, as i understand it, you need to prove that you EARN in excess of £18,600 not that your basic salary is £18,600+. Afterall, if you were self-employed you would have no basic salary, and would surely need to show evidence that you have the ability to earn £18,600. With, as i said, P60's and 6 months payslips etc. HTH.

Thank you for your email.

Your partner can continue to use this visit visa in order to visit the UK.

She must continue to demonstrate that she meets the requirements of paragraph 41 of the Immigration rules.

If her intentions change from that of a general visit she would not longer meet the requirement of the rules and should apply for a different visa which is more appropriate to her circumstances and intentions

However to confirm she can continue to visit the UK on her visit visa and should remain compliant with its conditions

So ....Good news then,We can now have a belated honeymoon in belfast for a few weeks before oksana goes back to yekaterinburg and we start the spouse visa application with RR
