Hi eveybody... I have a few question and wonder if anyone could help me, I am British and Married my wife is Russian. ( We where married in Moscow 2008 )
I meet my Lara (wife) in 2005 and got married in Aug 2008,my wife has been to England with first a six months Visa and then a Two year Visa which has finish in Dec 2011, but could not stay in England very long as her situation was looking after her Mother who has had a Heart Attack and is paralysis down one side and need 24 hours attendant, feeding and washing etc, we dont know how long she will live for and is very difficult for my wife to come to England, so i travel to Russia twice a year three months at a time to see my Wife and Daughter (17 this year) and Mother , and Both want a Settlement Visa. Both of us are retired and receiving Pension.
The information i need is which way is the best way to do this ?
(1) Apply for Settlement Visa now for both ? (Both not stayed in England for a long time )
(2) Wait until we have been Married for four years ?
(Which will be 7th Aug 2012 )
(3) Apply for another 2 or 5 year Visa ?
(4) Which Forms Numbers do i need to fill in? (FLR(M) )
(5) The last Visa Lara had was a two year Type 'C' multi 180 days Visa which finish in Dec 2011 is this the same visa we need this time ?
(6) The 9 months stay in England can this be over the two year Visa not a stright 9 months ?
(7) If they both get this two year Visa and the time go passed the Daughters 18th Birthday (say six months) can she still be eligible for settlement with Mother ?as she got the Visa before her 18th Birthday.
(8) Is there any problem if we delay this Visa which will not continue from the last one (say six months between) as she is looking after her mother or how long can she stay without renewing Visa
Can anyone Help me on this,

Wow difficult to answer without specific dates, such as when your wife came, how long she stayed in UK, how long she has been in Russia and so on, however ...
It may be possible for her to apply for ILR now depending upon how long she has been out of the country, of course, if you don't know how long she will continue to be outside of the UK, this maybe a waste of money and time. Not knowing the situation with your mother in law then I am afraid you will simply have to either take a chance on ILR or go back to square one and apply for a spouse visa when your wife is ready to move to the UK.
The real concern is for your 17 year old daughter, because the clock is ticking for her and she may miss the chance to get ILR and thus citizenship and may not be able to join you to live in the UK - please do address this immediately if this is important to you. It is complicated by the fact that she would not be able to get a visa to settle in the UK as her mother would be in Russia and also because she is 17 and a half.
If anything I would suggest you send your daughter back and apply for ILR for her ASAP - this is of course subject to dates and time out of the country.

As Chris says above (and as my email reply to you) that is the most urgent and pressing problem you have.
The answer is to apply for settlement for both now and your stepdaughter to live here in the UK with you until your wife is able to come full time.
